1. Acceptance of Terms
By accessing or using the K2P Platform, users agree to be bound by these Terms & Conditions, Privacy Policy, and applicable laws of India.
2. Eligibility
- Users must be at least 18 years old.
- Users must have legal capacity to enter into contracts.
- Users must provide accurate and complete information during registration.
3. Platform Role
- The Platform acts solely as an online marketplace connecting buyers and sellers.
- The Platform is not a party to any transaction between buyers and sellers.
- The Platform does not guarantee ownership, quality, authenticity, legality, condition, or value of listed items.
4. Real Estate Terms
Seller Responsibilities
The seller agrees that:
- They are the lawful owner or authorized representative.
- Property details, photographs, dimensions, approvals, and pricing are accurate.
- The property is free from undisclosed legal disputes, encumbrances, or claims.
- All applicable approvals and permissions have been obtained.
Buyer Responsibilities
The buyer agrees to:
- Independently verify ownership documents.
- Verify title deeds, encumbrance certificates, approvals, and applicable registrations.
- Conduct legal due diligence before making payment.
Disclaimer
The Platform does not verify property ownership, market valuation, government approvals, or the legal status of any property listing.
5. Second-Hand Automobile Terms
Seller Responsibilities
The seller warrants that:
- They are the registered owner or authorized seller.
- The vehicle is not stolen.
- Vehicle information provided is accurate.
- Valid RC, Insurance, PUC, and other required documents are available.
- Any loan or hypothecation details are disclosed.
Buyer Responsibilities
The buyer agrees to:
- Physically inspect the vehicle before purchase.
- Verify RC, Insurance, PUC, Service History, and ownership records.
- Complete ownership transfer through the relevant RTO.
Ownership Transfer
- Buyer and seller shall complete ownership transfer within the statutory period.
- The Platform shall not be responsible for delays in RC transfer.
- Parties must retain copies of Forms 29 and 30 and all transfer documents.
Vehicle Condition Disclaimer
Vehicles are sold on an "As Is Where Is" basis. The Platform provides no warranty regarding mechanical condition, accident history, odometer accuracy, or future performance, unless expressly stated by the seller.
6. Used Mobile Phone Terms
Seller Responsibilities
The seller confirms that:
- The mobile phone belongs to them.
- The device is not stolen, blacklisted, or financed.
- IMEI information provided is accurate.
- Device condition is correctly described.
Buyer Responsibilities
The buyer shall:
- Verify device condition before purchase.
- Check IMEI status and device functionality.
- Confirm accessories and warranty status before payment.
No Warranty
Unless specifically stated, used devices are sold "As Is". No manufacturer warranty is guaranteed. No return or replacement is available after the successful completion of a transaction.
7. Prohibited Activities
Users shall not:
- Post false or misleading listings.
- Upload fraudulent documents.
- List stolen property, vehicles, or devices.
- Manipulate pricing.
- Use the Platform for unlawful purposes.
- Harass or defraud other users.
8. Payments
- The Platform is not responsible for disputes arising from payments made directly between users.
- Users should use secure and traceable payment methods.
- The Platform may charge listing fees, subscription fees, brokerage fees, or service charges where applicable.
9. Limitation of Liability
The Platform shall not be liable for:
- Fraud by users.
- Property disputes.
- Vehicle defects.
- Mobile device defects.
- Financial losses arising from transactions.
- Delays in ownership transfer.
- Misrepresentation by buyers or sellers.
10. Account Suspension
The Platform reserves the right to:
- Remove listings.
- Suspend accounts.
- Terminate access without notice for violations of these Terms.
11. Governing Law
These Terms shall be governed by the laws of India. Any dispute arising out of these Terms shall be subject to the exclusive jurisdiction of the courts of Khammam, Telangana, India.
